1. Service Description

Stepwik is a SaaS content platform that enables users to:

• Create, publish, and manage codelabs and educational courses
• Utilize AI-powered features to assist in writing, editing, and optimizing content
• Share educational content with a global community
• Access premium features through subscription plans

2. Account Registration and Eligibility

By creating an account on Stepwik, you agree to these Terms, as well as any updates or changes made over time. If you do not agree to the Terms, you may not access or use the platform.

• Age Requirement: To use Stepwik, you must be at least 13 years old, and if under 18, you must have parental or legal guardian consent.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access to your account.

3. Subscription Plans and Billing

4. Cancellation and Refund Policy

Cancellation: You can cancel your subscription at any time. If you cancel, your access will remain active until the end of your current billing period. No refunds are provided for partially used periods.

Refunds: All subscription fees are non-refundable except as required by applicable law. If you cancel during a billing period, you will continue to have access to premium features until the end of that period.

5. Content Ownership and Intellectual Property

Your Content: You retain ownership of all content you create, publish, or upload to Stepwik ("Your Content"). By publishing content on Stepwik, you grant us a worldwide, non-exclusive, royalty-free license to use, display, distribute, and modify Your Content solely for the purpose of operating and promoting the Stepwik platform.

AI-Generated Content: When using our AI features to generate or enhance content, you acknowledge that AI-generated content may be based on publicly available information and training data. You are responsible for reviewing, editing, and ensuring the accuracy and appropriateness of all AI-assisted content before publishing.

Platform Content: All content, features, and functionality of the Stepwik platform, including but not limited to text, graphics, logos, and software, are owned by Stepwik or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. AI Features Usage

Stepwik provides AI-powered features to assist you in creating and optimizing content. When using these features:

• You acknowledge that AI-generated content is provided "as is" and may require review and editing
• You are responsible for ensuring that AI-assisted content complies with these Terms and applicable laws
• We do not guarantee the accuracy, completeness, or quality of AI-generated content
• AI features may be subject to usage limits based on your subscription plan

7. User Responsibilities and Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Publish content that is defamatory, harassing, abusive, or harmful
• Upload malicious code, viruses, or any harmful software
• Attempt to gain unauthorized access to the platform or other users' accounts
• Use the platform for any illegal or unauthorized purpose
• Interfere with or disrupt the platform's operation or servers
• Use automated systems (bots, scrapers) to access the platform without authorization

Stepwik reserves the right to remove or moderate content that violates these Terms or is deemed inappropriate, as well as to suspend or terminate accounts for repeated violations.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the platform will be available at all times or free from errors. We reserve the right to:

• Modify, suspend, or discontinue any part of the platform at any time
• Perform scheduled or unscheduled maintenance
• Update features, functionality, or user interface
• Change subscription plans, features, or pricing

We will make reasonable efforts to notify users of significant changes or service interruptions.

9. Third-Party Services

10. Termination

• Any outstanding subscription fees remain due

11. Disclaimer of Warranties

We provide Stepwik "as is" and "as available," without any warranties, express or implied. We do not guarantee that the platform will always be error-free, uninterrupted, or secure. Your use of the platform is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Stepwik and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

13. Indemnification

You agree to indemnify and hold harmless Stepwik, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

14. Changes to Terms

Stepwik may modify these Terms over time, and any updates will be posted on the platform with an updated "Last Updated" date. Continued use of Stepwik after changes go into effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the platform and cancel your subscription.

15. Copyright and Intellectual Property Rights (DMCA)

DMCA Takedown Requests: If you believe that content on Stepwik infringes your copyright or other intellectual property rights, please send a written notice to support@stepwik.com containing:

• Identification of the infringing material and its location on Stepwik
• A statement that you have a good faith belief that the use is not authorized

Counter-Notification: If your content is removed due to a DMCA notice and you believe it was removed in error, you may submit a counter-notification to support@stepwik.com.

Repeat Infringers: We reserve the right to terminate accounts of users who are repeat copyright infringers.

16. API Terms of Use

If you have access to Stepwik's API (Application Programming Interface) through your subscription plan, the following terms apply:

• API Access: API access is granted based on your subscription tier and may be subject to rate limits and usage restrictions.
• API Keys: You are responsible for maintaining the security of your API keys and must not share them with unauthorized parties.
• Rate Limits: API usage is subject to rate limits to ensure fair usage and platform stability. Excessive usage may result in temporary restrictions.
• Prohibited Uses: You may not use the API to:
  • Scrape or extract data beyond reasonable use
  • Create applications that compete with Stepwik
  • Circumvent subscription limitations or access controls

• Support: API support is provided according to your subscription tier. Enterprise plans may include dedicated API support.

17. Beta and Preview Features

Stepwik may offer beta, preview, or experimental features that are still in development. These features:

• May be modified or discontinued at any time without notice
• May not be suitable for production use
• May have different terms of use than standard features

Stepwik shall not be liable for any failure or delay in performance under these Terms that is due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, labor disputes, government actions, internet failures, or other force majeure events.

19. Entire Agreement and Severability

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stepwik regarding your use of the platform and supersede all prior agreements.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

You may not assign or transfer these Terms or your account without our prior written consent. Stepwik may assign these Terms, in whole or in part, at any time without notice.

21. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration or in a court of competent jurisdiction, as applicable.

Class Action Waiver: You agree that any disputes will be resolved individually and not as part of a class action or representative proceeding.
